Court upholds Stella Oduah’s election

Justice Adeniyi Ademola of an Abuja Federal High Court, has upheld the election of Stella Oduah, former aviation miniater, as the senator representing Anambra north senatorial district.

Justice Adeniyi in his ruling said that since the law is emphatic that no court should inquire into any primary election of a political party, any attempt to attempt that will amount to futility.

The suit was instituted by Magarene Chuba-Okadigbo challenging the primary election that saw Oduah as a candidate for the Peoples Democratic Party (PDP) in the 2015 general elections.

The court in its ruling averred that Section 31 of the electoral Act, 2010 and 251 of the 1999 Constitution as amended are categorical and unambiguous, as such the primary election is an internal affair of a political party and should not be inquired into by any court of law.

He also said that he had carefully studied the case of the despondent and found out that there was no dispute in the fact that the issue under contention was the party’s primary election of December 7, 2014.
