Accord party urges tribunal to strike out APC’s petition

Kehinde Ayinla of Accord Party on Thursday urged the Election Petition Tribunal sitting in Ibadan to strike out the petition filed by Mr Mutiu Raji of APC.

Raji had filed a petition through his counsel, Mr Kazeem Gbadamosi, challenging the declaration of Ayinla by INEC as the winner of the election into the Oyo State House of Assembly for Ibadan North East 1 Constituency.

Babalola Falola, counsel to Ayinla and Accord party, said that the petition by Raji did not comply with the provisions of the law as contained in the Electoral Act.
Falola, therefore, prayed the court to strike out the petition.

But in his reply, Gbadamosi said that he had filed a counter affidavit dated July 1 and had served it on the respondents, urging the court to dismiss the prayer of the respondents.

The Chairman of the tribunal, Justice J.G Abundaga, however, said that the court would reserve ruling on the application for the striking out of the petition till the day the judgment would be delivered on the main petition.

Abundaga said that the tribunal would go on with the hearing of the main petition so as to do justice to it and give all parties a fair hearing.

He adjourned the case to July 6 for pre-trial conference.

The Independent National Electoral Commission was also a respondent in the suit.
